HERSTMONCEUX PARISH COUNCIL

Minutes of Herstmonceux Parish Council held at 7.00pm on Monday 16th May 2005 at the Village Hall, Herstmonceux.

Present: Councillors J Angear, J Bingham, J Crittenden, J Crouch, D Goldman, M Goodsell, D Gordon, W Gower, B Naish, F Preedy and J Tate.

Also present were eight members of the public.

Mrs J McInnes, the clerk was in attendance.

05.41 ELECTION OF CHAIRMAN AND VICE CHAIRMAN

Chairman – Councillor Goldman was elected Chairman, proposed by Councillor Crittenden, seconded by Councillor Preedy. All councillors in favour.

Vice chairman – Councillor Crouch was elected, proposed by Councillor Bingham, seconded by Councillor Goodsell. All councillors in favour.

05.42 APOLOGIES FOR ABSENCE

Apologies were received from the RFO, Mr Goacher, who was unwell and Mr R Thomas, East Sussex County Councillor, who was attending the inauguration of the new Chairman of East Sussex County Council.

05.43 MINUTES

The minutes of the meeting held on 18th April 2005 have been circulated.

It was then resolved that the minutes be approved, adopted and signed as the correct record, proposed by Councillor Crouch, seconded by Councillor Angear.

05.44 MATTERS ARISING FROM MINUTES

All weather pitch – copies of construction schedule and publicity pack have not yet been received from Mr Woodland.

Clerk’s Report item 3 – the Ground committee will consider Recreation Ground rules and information re bookings to users.

Parish Plan Report – Mrs Town has informed the Council that she is not able to take on the task of producing a publication of local events. This item will be put on the agenda for the next Council Meeting.

05.45 FINANCIAL OFFICERS REPORT AND ACCOUNTS FOR PAYMENT

The meeting having been presented with the Payment of Account Report and accompanying vouchers, authorised expenditure totalling £7613.22 (copy attached) proposed by Councillor Preedy, seconded by Councillor Goodsell.

An estimate of £7000 had been received for the second phase of repairing and replacing lighting columns. It was proposed by Councillor Bingham, seconded by Councillor Gower to accept this estimate. All councillors in favour.

The clerk informed the Council of the various broadband offers available and indicated that the package from Tiscali was her preferred option. It was proposed by Councillor Preedy, seconded by Councillor Bingham to order the Tiscali broadband connection. All councillors in favour.

The clerk also informed the council that the new computer had arrived and should be installed in the near future. The costs for installing the computer had been investigated by the clerk and the following quotes obtained:

Computer Plus £37.50 per hour plus VAT, plus a £15 call out charge.
PC Doctor - £55 per hour plus VAT.
McInnes Computer Services - £40 per hour. It was proposed by Councillor Angear, seconded by Councillor Preedy that McInnes Computer Services should be paid to install new computer and transfer data from existing computer. It was estimated that the work would take approximately two and a half hours.

Parish Council Comments to Wealden District Council: The Parish Council considers that this proposal is oversized for the site.

Application: WD/05/0948/F
Applicant: Mike Chewter Associates
Location: The Old Builders Yard, West End, Herstmonceux.
Description: New single storey dwelling to replace 100 year old commercial buildings and site.
Parish Council Comments to Wealden District Council: The Parish Council considers that this is an over development of the site and expresses the following concerns:

the existing building has already been demolished without the necessary permission.
the proposed dwelling should further back on the site to enable a turning area, to prevent the necessity for cars to reverse onto the extremely busy highway.
The dwelling should be single storey with no living accommodation or windows in the roof space.

Comments above are the recommendations from the planning committee. However, they have not been submitted as a letter was received on 16.05.05 from a neighbour and the Council wishes to have time to consider these comments. A meeting was held on 23.05.05 and the following comments forwarded to WDC:

The Council strongly objects to this application:

it is an over development of the site.
A smaller building should be located further back on the site to allow a turnaround.
it is an intrusion on the neighbours’ privacy.
there should be no insertion of first floor living area and window, in accordance with conditions imposed on application WD/02/0910/F.
there is inadequate parking for this site and the neighbouring property. The proposed drive of 2.25 metres is too narrow for vehicular access, as the applicant has sold part of the original access to the neighbouring property.
there could be a fire risk in the siting of the oil tank. There is a well located adjacent to the proposed oil tank which could cause pollution to underground watercourses.
there are traffic hazards by vehicles having to reverse out onto the highway.
there will be an increase in parking on the street, in an already overcrowded road.
the height of the building gives concern in respect of privacy and light.
The council is concerned at the existence of Japanese Knotweed on the site; any building activity could cause this to spread, as it has already to the neighbouring property. The Council understands that under the terms of the Wildlife and Countryside Act 1981, it is an offence to spread the plant.

Location: The Old Stable Yard, Bemzells Lane, Cowbeech.
Description: Three bedroom house. Amended plan showing minor reduction in floor area of proposed dwelling and revisions to design.
Parish Council Comments to Wealden District Council: The Parish Council wishes to repeat its previous strong objections to this application as there is no justification for a new residential building in an Area of Outstanding Natural Beauty.

Comments above are the recommendations from the planning committee. However, they have not been submitted as a letter was received on 16.05.05 from the applicant and the Council wishes to have time to consider these comments. Meeting was held on 23.05.05 and following comments forwarded to WDC: The Parish Council supports this application as new information has been made available:

the existing mobile home has a Certificate of Lawful Use and Development WD/03/0730/LD. The third Schedule allows for the use of land for the stationing of a mobile home and its use as a separate dwelling unit – the Parish council would prefer to see the mobile home replaced with a permanent structure.
the proposed development is in AONB and the Parish Council considers that it is important that all materials are in keeping.
the existing mobile homes should be removed as soon as the permanent dwelling is erected.
the existing rights for a mobile home should be removed after the completion of a permanent dwelling.

Parish Council Comments to Wealden District Council: The Parish Council considers that this site is more suited to domestic accommodation rather than business use, which would cause an increase in traffic, which is already a problem in Cowbeech.

Application: WD/04/2822/F
Applicant: Mr and Mrs T Vaughan
Location: Woodcote Farm, Cowbeech.
Description: Change of use of two former poultry barns.
Parish Council Comments to Wealden District Council:
The Parish Council objects to this proposal:

It considers that there has been insufficient consultation.
The majority of residents in Cowbeech are against the proposal.
One of the conditions of the permission granted in 1977 stated that : This permission is granted for the erection of the buildings for so long as they are required and used in connection with agriculture as defined in the Town and Country Act 1971, and within six months from the date on which any building ceases to be so required and uses it shall be removed and the site or relevant part thereof reinstated to the satisfaction of the District Planning Authority. The Parish Council considers that this condition should be enforced.
On the occasion of the Parish Council’s site visit to the site, the barns were empty.
The applicant informed the Parish Council that all agriculture had ceased at the site.

05.49 QUALITY PARISH COUNCIL STATUS

Nothing to report.

05.50 REVIEW OF REMIT OF COMMITTEES

Proposals were put forward to councillors for discussion and the following terms of reference were agreed:

Finance and General Purposes Committee

The Finance and General Purposes Committee (F&GPC) consists of the Chair and Vice Chair of the Parish Council and three elected councillors. It meets on the first Wednesday of every month at 7.00 in the Small Hall of the Village Hall. Members of the public are welcome to attend committee meetings.

The F&GPC makes proposals on the matters within its remit in a monthly report to the Parish Council. In a matter of urgency, it can take action on behalf of the Parish Council for the benefit of the parish.

The F&GPC considers major financial issues, including proposals for the precept presented to the November meeting of the Parish Council. It advises the Council on officers' salaries, pay awards and contractual arrangements. It makes proposals for what grants should be awarded each August.

It considers policy issues and matters of general concern and in 2005-6 will oversee progress towards Quality Council status.

Ground Committee

The Committee consists of three elected members.

Meetings will be held as necessary.

The committee has responsibility for the maintenance, development and overall responsibility of the Recreation Ground, Lime Cross Field and the Village Green, and the equipment thereon.

In an emergency, the Ground Convenor may spend £250; for sums above this amount the approval of the Chair of the Council and the RFO must be sought.

Members draft responses to relevant correspondence, surveys etc. and attend appropriate outside meetings where possible.

The committee provides the RFO with a written estimate of any expenditure it wishes/expects to incur in the coming year no later than 31 October so that it may be incorporated in the estimates at the November meeting of the Parish Council.

Footpath Committee

The committee consists of three elected members.

Meetings will be held as necessary.

The committee:

convenes to inspect any footpath matters that are reported to the Council.

reports to full Council on any action needed.

liases with the Walking Club to receive information on any problems with footpaths.

In an emergency, the committee may spend £50; for sums above this amount the approval of the Chair of the Council and the RFO must be sought.

Members draft responses to relevant correspondence, surveys etc. and attend appropriate outside meetings where possible.

The committee provides the RFO with a written estimate of any expenditure it wishes/expects to incur in the coming year no later than 31 October so that it may be incorporated in the estimates at the November meeting of the Parish Council.

Emergency Planning Committee

The committee consists of three elected members. It currently has one co-opted member.

Meetings will be held as necessary.

The Committee will:

ensure that there is an Emergency Plan in place for the Parish.

regularly review the plan and its procedures and keep the contact lists up to date.

keep fellow Parish Councillors involved and regularly informed.

publicise the existence of the plan to the residents

In an emergency, the committee may spend £50; for sums above this amount the approval of the Chair of the Council and the RFO must be sought.

Members draft responses to relevant correspondence, surveys etc. and attend relevant outside meetings where possible.

The committee provides the RFO with a written estimate of any expenditure it expects to incur in the coming year no later than 31 October so that it may be incorporated in the estimates at the November meeting of the Parish Council.

Street Lighting

Meetings will be held as necessary.

The committee:

is responsible for reporting all faulty lights in the parish to ESCC.

makes recommendation to full Council on maintenance and updating of lampposts as necessary.

Members draft responses to relevant correspondence, surveys etc. and attend relevant outside meetings where possible.

The committee provides the RFO with a written estimate of any expenditure it wishes/expects to incur in the coming year no later than 31 October so that it may be incorporated in the estimates at the November meeting of the Parish Council.

Highways and Traffic

Meetings will be held as necessary.

The committee will liase between the Parish Council and ESCC Highways Department in highways matters relating to traffic and roads and County Council maintained footpaths.

In an emergency, the committee may spend £50; for sums above this amount the approval of the Chair of the Council and the RFO must be sought.

Members draft responses to relevant correspondence, surveys etc. and attend appropriate outside meetings where possible.

The committee provides the RFO with a written estimate of any expenditure it wishes/expects to incur in the coming year no later than 31 October so that it may be incorporated in the estimates at the November meeting of the Parish Council.

Children and Young People

Meetings will be held as necessary.

The Committee will:

take an interest in activities, groups and organisations providing or extending amenities for children and young people in the Parish.

support relevant initiatives.

act as a channel of communication between such activities and the Council.

In an emergency, the committee may spend £50; for sums above this amount the approval of the Chair of the Council and the RFO must be sought.

Members draft responses to relevant correspondence, surveys etc. and attend appropriate outside meetings where possible.

The committee provides the RFO with a written estimate of any expenditure it wishes/expects to incur in the coming year no later than 31 October so that it may be incorporated in the estimates at the November meeting of the Parish Council.

Planning Committee

The Planning Committee consists of all 11 parish councillors and has a quorum of 6. Six councillors are elected to have special responsibility for planning — should they not be able to attend a Planning Committee meeting it is their responsibility to inform the Clerk in good time.

The Committee has delegated powers to consider and comment on planning applications.

In advance of the meeting the Clerk informs members of the plans to be discussed.

The Committee meets on the second Wednesday of every month at 7.30pm in the Herstmonceux Village Hall.

Site meetings are arranged as necessary. Councillors should notify the Clerk in good time if they feel a site visit is necessary.

Members draft responses to relevant correspondence, surveys etc. and attend appropriate outside meetings where possible.

The Clerk is willing to take the minutes but this will require additional payment. However, this may be accommodated in the current pay re-structuring

05.51 ANNUAL REVIEW OF STANDING ORDERS

The following changes were proposed and agreed, to the Standing Orders made on 17.05.82 amended May 2004.

2(b) – in other years on the third Monday in May.

16(i) – to receive and consider reports from officers of the Council, preferably written.

16(j) - to receive and consider reports and minutes of committees and advisory committee, preferably written.

41.2(b) – Planning Committee – all councillors are members of the planning committee. The quorum for the planning committee is six councillors. Six councillors will be elected to have special responsibility for planning. If these councillors are unable to attend a planning meeting, they inform the clerk. The planning committee has delegated powers to forward comments on behalf of the Council to Wealden Distrcit Council on all planning applications.

41.2(f) – representatives to outside bodies will be appointed at the Annual Meeting.

41.2(g) – Councillors with special responsibilities for Highways and Traffic, Street Lighting, Tree Warden, Children and Young People will be appointed at the Annual Meeting. Reports to be made as appropriate.

41.5 – add the following sentence – In an emergency, for sums beyond this, the approval of the chairman of the Council and RFO should be sought.

41.6 – East Sussex County Councillor and Wealden District Councillor will be given the opportunity to speak in the report section of Council Meetings.

73.1 – number to 73 and change to; the clerk shall, as soon as it is received keep a record of the planning applications notified to the council and refer to the Chairman of the planning committee as soon as practicable.

73.2 – delete.

It was proposed by Councillor Preedy and seconded by Councillor Bingham to accept the proposals. All councillors in favour.

It was agreed the incorporate the changes needed by the change in remit of committees:

An increase in the quorum for the Planning committee.

The delegation of powers to the Planning Committee.

05.53 BUS SHELTERS AND SIGNS IN PARISH

Bus shelter and signs in parish are due to be cleaned by Parish maintenance team.

05.54 CLERK’S REPORT – PART ONE

Correspondence

ESCC – informing the Parish Council that funding is available for Parish Maintenance Teams for 2005 and asking if the Parish Council wishes for any work to be carried out this year. After discussion with the Chairman, Councillors Bingham, Gower and Angear, I have contacted ESCC requesting for work to be undertaken by the Maintenance Team.

WDC – Forward Plan of Key and Other decisions.

WDC – requesting information on the Parish Council’s views on seeking Quality Council Status. Details of PC’s interest has been forwarded to Mr Garrett at WDC.

Wealden Local Strategic Partnership reminding the Parish Council of the networking event at Uckfield on13.04.05.

Mr Galitzine – expressing concern at dogs in the children’s play area on the Recreation Ground. Copied to Councillor Crouch.

South East Water – posters to raise public awareness on their use of water.

East Sussex Fire and Rescue Service – asking the Parish Council whether they have any ideas or suggestions for joint community safety themes. Mr Yates, Senior Fire Officer asked the Councuil to support this initiative. The Council agreed, Mr Yates will contact Council with more details.

Eon Energy – details of the street lighting contract renewal. It was proposed by Mr Bingham, seconded by Mr Goodsell to accept this renewal. All councillors in favour.

Lexis Nexis – details of payroll course.

RoSPA informing the Parish Council that it has not booked a play area inspection this year. Clerk will investigate charges from other agencies who inspect playgrounds.

Correspondence

Mrs Woodcock – informing the Council that the footpath outside Newhaven in Gardner Street is uneven. This caused her to have an accident in her invalid buggy. Copied to Councillor Gower. Letter has been forwarded to ESCC Highways and an engineer will inspect site.

SALC – details of training weekend for new clerks and councillors 10-12 June at Dunford House, Midhurst.

Wealden Federation of Voluntary Organisations – details of an event for older people in Wealden on 1.06.05 at Heathfield Community Centre, Heathfield. Details forwarded to the Ray and Sheldon Club.

Mr Lewis – supporting the Parish Council’s opposition to the planning application at Albert’s Woodyard, Windmill Hill.

05.55 REPORTS

Finance and General Purpose – report circulated to councillors. After clarification of points 1, 7 and 13 it was agreed to accept recommendations for the response to the Code of Conduct consulation. Hidden Britain Project Group is complete for this area.

Footpaths – stile on footpath adjacent to former Shaws Garage in Cowbeech will be repaired by Mr Ford.

School Governor – no report.

Village Hall – no report.

Wealden Association of Local Councils – no meeting.

Neighbourhood Watch – report circulated.

Herstmonceux Castle Liaison – no report.

Tree Warden – no report.

Ground Committee –

Litter: Is the arrangement for a monthly or four weekly collection of the large green bin and the small bins in place. The RFO has confirmed collection with WDC. Any reply from E. S. C. C. re the responsibility of the litter on the path One of the small bins needs a new 'inside'. Mr Goodsell will replace. We would like to arrange a 'Community Litter Day' asking parishioners to clear the immediate vicinity of their own property and help clear areas such as the recreation ground. 'The Summer in Bloom inspection usually takes place early in July so maybe either Saturday 2nd July or Sunday 3d July would be the best time. It was agreed that community Litter Day should be 3rd July.

We also think the council should consider employing somebody to keep the recreation ground clear. This will be referred to F & G P.

Seats: There is one concrete seat left in a poor state of repair but we feel that this should be removed rather than replaced as there is adequate seating without it. It was agreed to remove this seat.

R.O.S.P.A. recommendations are in hand.

M.U.G.A. There is not room for the pitch between the cricket nets and the tennis courts without resiting the sheds and also it was felt that the lights would be more obtrusive. Also we consider that a goal and a basketball net should be made available on the outside of the fence for free and open use. It was agreed that Councillor Crouch should investigate cost of basket ball/football nets to be sited outside the proposed MUGA pitch. There is funding available from AiRS – local church or community groups would be eligible to apply.

Street Lighting –

Councillor Bingham has had a meeting with Mr Innes from Owen Williams re the phased replacement of old lighting columns in Herstmonceux. Four columns will be replaced in the next phase and photoelectric cells installed in all existing columns.

Six of the eight orange lenses have been replaced and the remaining two will be changed when the new columns are installed.

Light outside Pickpale, Windmill Hill is obscured by overhanging branches,. Clerk to approach owners.

Highways – no problems reported.

Emergency Plan – no meeting. Mr McInnes will attend June meeting to update councillors.
